Divorce in Washington: What to Consider & What to Expect

When considering a divorce in Washington State, it's important to understand the key requirements and what you can expect throughout the process. Before reaching out to a lawyer, it's helpful to gather all relevant financial documents, consider your goals for post-divorce life, particularly regarding living arrangements, finances, and co-parenting, and reflect on your readiness for the emotional aspects of the divorce process.

At Hallack Law, PLLC, based in Seattle and serving clients across King County, I'm here to guide you through every step of this significant life change with compassion and a thorough understanding of Washington family law.

Residency Requirements for Divorce in Washington

Before filing for divorce in Washington, there's no strict residency requirement for either spouse. However, you must file in the county where you or your spouse resides.

Since I serve clients throughout King County, including Bellevue, Renton, Kent, Auburn, Enumclaw, Issaquah, Snoqualmie, North Bend, Kirkland, Redmond, Woodinville, and Skykomish, I can help you determine the most appropriate venue for your case.

Understanding "No-Fault" Divorce

Washington is a "no-fault" divorce state, meaning that you don't need to prove wrongdoing or fault by your spouse to obtain a divorce.

The only ground for divorce here is the irretrievable breakdown of the marriage. This aspect simplifies the process, focusing on equitable resolutions rather than placing blame.

The Divorce Process

The divorce process begins with filing a Petition for Dissolution of Marriage. Once filed, your spouse must be served with the divorce papers and given time to respond. If both parties agree on all aspects of the divorce, including asset division, child custody, and support arrangements, the process can move relatively quickly.

However, if there are disputes, the process may involve mediation, settlement negotiations, and possibly a trial. It's crucial to have a clear understanding of your rights and obligations regarding shared assets, debts, spousal support (alimony), and if applicable, child support and custody arrangements.

Waiting Period

In Washington, there's a mandatory 90-day waiting period from the date your spouse is served with divorce papers before the divorce can be finalized. This period allows both parties time to work out an agreement or prepare for court, if necessary.

Community Property

Washington follows the community property rule, meaning that all assets and debts acquired during the marriage are considered to be owned equally by both spouses and are subject to division upon divorce. However, equitable does not always mean equal, and the court will aim to reach a fair distribution based on various factors, including the length of the marriage and each party's financial situation.

Qualified Domestic Relationship Orders

Qualified domestic relationship orders (QDROs) allow spouses or ex-spouses to collect money from retirement accounts. This type of domestic relationship order is a necessity when a portion of a spouse’s retirement account or pension plan is awarded to the other spouse in a divorce.

Understand Your Options

Every divorce is different. Washington law makes space for different paths to dissolve a marriage, each with its advantages and challenges. At Hallack Law, PLLC, I can help you understand your options and choose the best route for your situation.

Uncontested Divorce: An uncontested divorce occurs when both parties agree on all major issues related to the dissolution of their marriage, including asset division, debt division, child custody, and spousal support. This type of divorce tends to be faster, less costly, and less emotionally draining than its counterpart, because it avoids drawn-out legal battles.

An uncontested divorce reflects a mutual desire to conclude the marriage amicably and efficiently, allowing both parties to move forward more peacefully. At Hallack Law, PLLC, I support and facilitate this process, ensuring that all agreements are fair, comprehensive, and legally binding.

Contested Divorce: A contested divorce arises when spouses cannot agree on one or more key aspects of their divorce settlement. Contested divorces are much more common than their uncontested counterpart, and they necessitate a more intensive legal approach, often involving mediation, negotiation, and possibly court trials.

Such cases require a robust legal strategy and assertive representation to protect your rights and interests. I'm here to stand by your side through any divorce challenges, advocating for your best outcomes every step of the way.
